A Traffic Charge Requires More than Paying the Fine

Paying a ticket online is a guilty plea. Points accumulate, insurance rises, and, for license charges, each conviction extends the revocation period.

A missed court date is reported to the DMV and produces an additional revocation, even when the original charge was minor. Benitez Family Law handles these matters early enough that they do not grow.

Matters we commonly handle

  • No operator’s license, NOL (N.C. Gen. Stat. § 20-7): Class 3 misdemeanor
  • Driving while license revoked, DWLR (§ 20-28): Class 3, or Class 1 when the revocation stems from a DWI
  • Speeding (§ 20-141)
  • Reckless driving (§ 20-140): Class 2 misdemeanor
  • Revocations for missed court dates or unpaid fines, and license restoration

What to do now

  1. Find the court date on your citation. If it has passed, contact us immediately; a warrant may exist.

  2. Do not pay the citation online without asking first.

  3. If you hold a license from another country or state, bring it to the consultation.

  4. Gather proof of your need to drive: employer letter, class schedule, medical appointments.

A thoughtful, strategic approach

  • Appearance without you. On most traffic citations, a signed waiver lets us appear on your behalf. We confirm at the consultation whether your charge allows it.
  • Charge reduction. A speeding charge can be reduced to a non-moving violation with no points.
  • Prayer for judgment continued (PJC) when it makes sense to protect your insurance.
  • Clearing old revocations so the DMV reinstates your license.

Frequently asked questions

Do I have to go to court?

For most traffic citations, no. We appear for you.

Can I get my license back?

Often, yes. We review your DMV record and design the restoration plan.

What is a limited privilege?

Court authorization to drive at specific times and places while your license is revoked.

Can I be arrested for driving without a license?

It is possible, though uncommon. The real risk is accumulation: each citation extends the revocation.
